1. Service and technical requirements

FinchSend is an online service for creating email campaigns, managing contacts and signup forms, storing campaign materials, sending messages and viewing reports. The service provider is identified in the operator details above.

You need internet access, an up-to-date browser with JavaScript and essential cookies enabled, and a working email address. Sending campaigns requires a correctly configured and verified sending domain. Plan features and current prices are shown in the pricing information and before payment.

2. Registration and account security

Provide a valid email address, choose a password and verify your address using the emailed link. The link is valid for 24 hours. A verified account is required to sign in. Anyone acting for an organisation must have authority to do so.

Keep your password and email account secure and report suspected unauthorised access to the operator’s contact address. Account registration does not constitute consent to receive marketing from FinchSend.

3. Contacts, content and sending rules

The anti-spam and acceptable use policy supplements these terms with rules on list sources, consent evidence, prohibited content, reputation, abuse reports and appeals against restrictions. It is linked in the footer and sources below and also prohibits purchased lists and cold outreach without prior permission.

You are responsible for collecting contacts lawfully, providing required privacy information and obtaining any consent required for marketing. Importing a contact or manually marking it verified does not replace evidence of consent. Spam and lists obtained without an appropriate legal basis are prohibited.

Signup forms require email confirmation (double opt-in). Campaigns target active, verified contacts, and eligibility is checked again before sending. You must not bypass an unsubscribe or remove or conceal the option to unsubscribe.

Unlawful content, phishing, malware, impersonation and infringement of others’ rights are prohibited. You retain rights to your materials and permit their processing as necessary to provide the service. Images used in emails are accessible through public links; do not upload confidential files to the image library.

4. Plans, payments and renewals

Available plans are Start, Growth, Ecommerce and Scale, with monthly or annual billing. Binding information about the total price, taxes, billing period and service scope must be presented before you confirm an order. Stripe handles payments; FinchSend does not store full card numbers or security codes.

Subscriptions automatically renew for the selected period until cancelled. You can request that renewal be disabled by contacting the operator at the address above before the next renewal date. The operator confirms the subscription end date. Stopping use or signing out does not cancel payments.

Cancelling renewal and deleting an account are separate actions. Any refund rights arising from withdrawal, complaints or other mandatory law remain unaffected.

5. Service operation and responsibility

Messages are sent in batches and may depend on the queue, domain configuration and email provider availability. Acceptance for sending does not guarantee inbox placement. Image blocking and automated scanners may affect open and click statistics.

The operator maintains the service and addresses reported faults. Advance notice of planned work that significantly affects access is provided where possible. These terms do not exclude liability or rights that cannot be limited by law.

6. Ending use and violations

You can request account closure at the operator’s contact address. Before closure, arrange the return of any data you need and the termination of an active subscription. The privacy policy describes data retained after the service ends.

In cases of spam, unlawful use or security threats, the operator may restrict sending or access to the extent needed to address the threat. You will be told the reason and how to contact the operator to resolve the issue unless prohibited by law.

7. Complaints

Send complaints to the operator’s email or correspondence address. Include your account email, the problem, when it occurred and the resolution you seek. Do not send your password or card details. The operator responds to consumer complaints within 14 days of receipt on a durable medium, such as email.

If the digital service does not conform to the contract, consumers may request that it be brought into conformity and, where provided by law, a price reduction or withdrawal. These rights also apply to others entitled to this protection by law. Consumer advisers can assist; UOKiK provides information about out-of-court dispute resolution.

8. Right of withdrawal

A consumer entering into a distance contract generally has 14 days from conclusion to withdraw without giving a reason. This also applies to individual entrepreneurs where statutory consumer protection extends to them. Send a clear statement to the operator by email or post before the deadline.

Example: ‘I withdraw from the contract for the FinchSend service concluded on [date]. Full name: [name]. Address: [address]. Account email: [email]. Date: [date].’ Add a signature for a paper statement. Using this example is optional.

Payments due for refund are returned within 14 days of receipt of the statement, using the same payment method unless another method is agreed without additional charges. Any charge for service started at the consumer’s express request before the withdrawal deadline is subject to statutory conditions. Creating an account, paying for a plan or starting to use the service does not itself declare a loss of withdrawal rights.

9. Personal data and recipient lists

The privacy policy explains account data, billing, cookies and campaign measurement. For your recipient list, you determine the purposes and legal grounds for processing, and FinchSend performs operations on your behalf.

Processing recipient data on your behalf requires a data processing agreement under Article 28 GDPR. The DPA and annexes are available through the ‘Data processing agreement (DPA)’ footer link. Neither these terms nor the privacy policy replace the DPA. Its final version must be concluded before entrusting a list; drafts cannot be accepted.

10. Changes and final provisions

Changes may result from changes in law, service scope or security requirements. The operator provides the wording, reason and effective date with appropriate advance notice on a durable medium. Changes do not remove acquired rights; changes to an ongoing digital service must meet statutory conditions, including termination rights where applicable.

Polish law applies without removing mandatory consumer protection under the applicable law. Jurisdiction is determined by law. This document is available without signing in and can be saved or printed using your browser.
